Terms and conditions of sale via the FYERE website portal
These terms and conditions of sale apply to all purchases of FYERE products made through the FYERE website portal. By placing an order, the customer confirms that they have read, understood and accepted these terms before completing the purchase. These terms are intended for sales to consumers and, where applicable, business customers. Mandatory consumer rights under Belgian law remain unaffected.
Products and product information: FYERE takes reasonable care to describe and present products accurately on the website, including key characteristics, materials, dimensions, colours and prices. Images are provided for illustrative purposes and may vary slightly from the product delivered, including due to screen settings, lighting, natural variations in materials or hand-finishing. Customers are responsible for checking the product details, size, quantity and delivery information before placing an order.
Orders and acceptance: An order placed through the website constitutes an offer by the customer to purchase the selected products. The sales contract is concluded only when FYERE confirms acceptance of the order by email or through the website portal. FYERE may refuse or cancel an order where a product is unavailable, where payment is not authorised, where there is a manifest pricing or product information error, where fraud or misuse is suspected, or where delivery cannot reasonably be made to the requested destination. If FYERE cancels an order after payment has been received, FYERE will refund the amount paid for the cancelled order – please refer to refund section below.
Prices, taxes and payment: Prices are stated in euros and include VAT where applicable, unless expressly stated otherwise. Delivery charges, customs duties, import taxes and other charges, where applicable, are shown or described before the customer confirms the order. Payment must be made using the payment methods available on the website portal at the time of purchase. The customer represents that they are authorised to use the chosen payment method. FYERE may suspend processing or delivery until full payment has been received and verified.
Availability: All products are subject to availability. If a product becomes unavailable after an order has been placed, FYERE will inform the customer as soon as reasonably possible and may offer an alternative product, a revised delivery time or a cancellation with refund. FYERE is not liable for temporary unavailability of products, except as required by mandatory.
Customer account and website portal: The customer is responsible for ensuring that all information provided through the website portal is accurate, complete and up to date. The customer must keep any account login details confidential and must promptly notify FYERE of any suspected unauthorised use of their account. FYERE is not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer. For the FYERE policy on treatment of customer data please refer to our general terms and conditions and privacy policy.
Delivery terms
Delivery area and methods: FYERE will deliver to the destinations and by the delivery methods made available on the website portal at checkout. Delivery options, estimated delivery times and delivery charges may vary depending on the destination, product availability, carrier and order value. FYERE may update delivery options at any time before an order is placed.
Delivery time: FYERE will use reasonable efforts to deliver within the estimated timeframe shown at checkout or in the order confirmation. Delivery dates are estimates unless expressly agreed otherwise. If delivery is delayed, FYERE will inform the customer where reasonably possible. For consumer sales, delivery will take place within a period of 3 to 7 working days, unless the parties have agreed a different delivery period.
Receipt and transfer of risk: For consumer customers, risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the goods. Where the customer independently chooses a carrier not offered by FYERE, risk may pass to the customer when the goods are handed to that carrier, subject to mandatory law.
Failed delivery: If delivery cannot be completed because the customer provided incorrect or incomplete delivery details, refuses delivery, fails to collect the parcel, or is unavailable after reasonable delivery attempts, FYERE may charge the customer for reasonable additional delivery, storage or return costs, to the extent permitted by law. FYERE may cancel the order and refund the customer after deduction of permitted costs where applicable.
Inspection on delivery: The customer should inspect the package and products promptly after delivery. Any visible damage, missing items or delivery error should be reported to FYERE as soon as possible, with photographs where relevant, so that FYERE can investigate with the carrier and assist the customer. This does not limit any mandatory consumer rights.
Returns, withdrawal and refunds
Consumer right of withdrawal: If the customer is a consumer and purchases products through the website portal, the customer has the right to withdraw from the contract within 30 calendar days without giving any reason, unless an exception applies. For goods, the withdrawal period starts on the day on which the customer, or a third party designated by the customer other than the carrier, receives the goods. Where an order is delivered in several parts, the period starts on receipt of the last item.
How to exercise withdrawal: To exercise the right of withdrawal, the customer must inform FYERE of the decision to withdraw by a clear statement before the withdrawal period expires exercisable only via the withdrawal function made available through the website portal. If the withdrawal function on the website portal is not working for whatever reason – customers are to immediately reach out to customer service to ensure this is properly dealt with.
Return of products: After notifying FYERE of withdrawal, the customer must return the products without undue delay and in any event no later than 30 days from the day on which the customer informed FYERE of the withdrawal. Products should be returned unused, complete, in their original packaging where reasonably possible, with all accessories, certificates, tags, protective materials and proof of purchase. The customer is responsible for the direct cost of returning the products unless FYERE has expressly agreed otherwise or unless FYERE failed to inform the customer that return costs would be borne by the customer.
Condition of returned products: The customer may inspect and handle the products only as necessary to establish their nature, characteristics and functioning, in the same way as would be permitted in a physical shop. The customer may be liable for any diminished value of the products resulting from handling beyond what is necessary for that purpose.
Refunds: Where the customer validly withdraws from the contract, FYERE will refund the payments received for the returned products, excluding standard delivery costs paid for the original delivery where required by law. FYERE may withhold reimbursement until it has received the returned products and inspected same. Refunds will be made using the same payment method used for the original transaction, unless the customer expressly agrees otherwise and provided that no additional fees are charged for the refund.
Exceptions to withdrawal: The right of withdrawal does not apply where Belgian or EU law provides an exception, including for products made to the customer’s specifications or clearly personalised, sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed after delivery, and other categories excluded by mandatory law. Where an exception applies, FYERE will inform the customer before the order is placed.
Exchanges: Exchanges may be offered at FYERE’s discretion and subject to product availability. If an exchange is not available, FYERE may process a return and refund in accordance with these terms, and the customer may place a new order.
Legal guarantee and defective products: Consumers benefit from the statutory guarantee of conformity under Belgian law. If a product is defective or does not conform to the contract, the customer may be entitled to the remedies provided by law, which may include repair, replacement, price reduction or refund, depending on the circumstances. These statutory rights are not limited by any commercial guarantee or by these terms.
The customer should notify FYERE of any suspected defect or non-conformity as soon as reasonably possible after discovery and provide a description of the issue, photographs where relevant, and proof of purchase. FYERE may ask the customer to return the product for inspection. If the product is confirmed to be defective or non-conforming, FYERE will bear the reasonable return costs and provide the applicable remedy in accordance with Belgian law.
Limitation of liability
Nothing in these terms excludes or limits liability where this would be unlawful, including liability for intentional misconduct, fraud, gross negligence where mandatory law so provides, death or personal injury caused by negligence, product liability, or mandatory consumer rights. Subject to mandatory law, FYERE is not liable for indirect or consequential losses, loss of profit, loss of opportunity, loss of data, or losses caused by the customer’s misuse of products, normal wear and tear, incorrect care, unauthorised repair or modification, or failure to follow product instructions.

Governing law, jurisdiction and consumer dispute resolution
These terms and any sales concluded through the FYERE website portal are governed by Belgian law. For business customers, the courts of Antwerp, Antwerp Division, have exclusive jurisdiction, unless mandatory law provides otherwise. For consumer customers, this jurisdiction clause applies only to the extent permitted by mandatory consumer protection rules, and consumers retain any rights granted by mandatory law to bring proceedings before the competent courts of their place of residence or domicile.
Where applicable, consumers may also seek information or assistance from competent consumer protection bodies or use any official consumer dispute resolution mechanisms made available under Belgian or EU law. FYERE’s participation in any alternative dispute resolution procedure will be as required by applicable law or as expressly agreed by FYERE.
